Well Certificates

If a conveyance document requires a Certificate of Real Estate value at the time of recording it will also need a Well Disclosure Statement.

If there are no wells on the property the instrument must contain a statement attesting to this fact.

If there is a well(s) located on the property a completed Well Disclosure Statement must accompany the document.

Or

If the seller can make the following statement on the document a Well Disclosure Statement is not needed “I am familiar with the property described in this instrument and I certify that the status and number of wells on the described real property have not changed since the last previously filed well disclosure certificate”.

If the deed being presented for recording is pursuant to a contract for deed then ONLY this statement can be used “Grantee certifies that the Grantee does not know of any wells on the described real property”
